Ninety-One One Thirteen, Right of Way, and the Pecking Order in the Sky That Decides Who Yields When Two Airplanes Meet

A pilot's guide to FAR 91.113 right-of-way rules - who yields when two aircraft meet, and why the right of way is a duty, not a privilege.

Under FAR 91.113, the aircraft with the least ability to maneuver has the right of way, and everyone with more options must yield. The rule builds a “pecking order” from an aircraft in distress at the top down to powered airplanes and rotorcraft near the bottom. Just as important: having the right of way is a responsibility to stay predictable - not permission to stop looking.

What Is FAR 91.113 and Why Does It Matter?

The right-of-way rules for aircraft live in Part 91 of the Federal Aviation Regulations, Section 91.113, titled “Right-of-way rules: Except water operations.” (Water operations get their own regulation.)

These rules matter because “see and avoid” is still the law in visual conditions. Your traffic display and ADS-B (Automatic Dependent Surveillance–Broadcast) are valuable tools, but the regulation names your eyes as the primary collision-avoidance system.

When two aircraft converge, one must move and one must hold steady. If both pilots guess, both guess wrong. The right-of-way rules exist to remove the guessing.

Who Has the Right of Way? The Maneuverability Ladder

The entire logic of 91.113 is a ladder ranked by maneuverability. The aircraft least able to get out of the way sits at the top, and everything below it must yield. Understand the “why” and you never have to memorize the list.

From the top down:

  • Aircraft in distress - an aircraft in a genuine emergency has the right of way over all other air traffic. Always number one.
  • Balloons - a balloon goes where the wind goes and cannot dodge. It yields only to an aircraft in distress.
  • Gliders - a sailplane works only with the energy it has and can’t add power to climb clear. It yields to balloons but outranks everyone below.
  • Airships - the blimp. Rarely encountered, but it’s on the ladder.
  • Airplanes and rotorcraft - the powered, steerable crowd. Most of us. Near the bottom, so we yield to nearly everybody.

There’s one rung that trips people up: an aircraft towing or refueling other aircraft has the right of way over all other engine-driven aircraft. Picture a tow plane dragging a glider on a rope - it can’t maneuver aggressively, so it gets bumped up high on the ladder.

No examiner expects you to recite this like a poem. They want you to understand the logic: a balloon can’t steer, a glider can barely steer, and here you come in a Cessna 172 with a throttle, a rudder, and every option in the world. You yield.

How Do Two Airplanes Decide Who Yields When They Meet?

Most of the time you won’t meet a balloon - you’ll meet another airplane like yours. The regulation spells out three specific situations for aircraft of the same category.

Converging: Give Way to the Aircraft on Your Right

Two airplanes at roughly the same altitude, on paths angling toward the same point. When aircraft are converging at approximately the same altitude, the aircraft to the other’s right has the right of way.

If traffic is off to your right, they have the right of way - you yield, usually by passing behind them, turning right, or slowing down to let them go first.

If traffic is off to your left, you generally have the right of way. But the right-of-way aircraft shall maintain course and speed - be predictable so the other pilot can plan around you. Keep looking anyway. If it’s clear the other pilot hasn’t seen you, you still have the authority to deviate.

One special note: if the two aircraft are of different categories, the maneuverability ladder takes over. A powered airplane converging with a glider yields to the glider, regardless of who is on whose right.

Head-On: Both Pilots Break Right

When two airplanes approach head-on or nearly so, each pilot alters course to the right, and they pass left side to left side - just like cars on a road.

Nobody has the right of way in a head-on meeting. Both aircraft move. The rule of thumb: when in doubt, break right.

Overtaking: The Aircraft Being Overtaken Has the Right of Way

When you come up behind a slower airplane going the same direction, the aircraft being overtaken has the right of way. The faster airplane behind must alter course to the right to pass, staying well clear.

This is huge in the traffic pattern. If you come up fast behind a slow taildragger on final, the taildragger wins - they were there first and they’re being overtaken. You go around, swing right, and give space, or break off and re-enter. You do not squeeze past.

Who Has the Right of Way on Final Approach and Landing?

Aircraft on final approach to land, or while landing, have the right of way over other aircraft in flight or on the surface. The airplane established on final - lower and closer to the runway - has it.

There’s a critical caveat written right into 91.113: you cannot use this rule to cut in front of, or overtake, another aircraft on final. You can’t dive down from the pattern, cut off a pilot already established on final, and then claim the right of way because you’re “on final now.”

When two or more aircraft are approaching to land at the same time, the aircraft at the lower altitude has the right of way - but the same caveat applies. Being lower never lets you steal an approach from someone who was already committed and closest to the ground.

Real-world safety note: this lower-altitude rule is exactly why you should never fly a long, low, straight-in approach to a non-towered field without a very good reason, heavy radio work, and constant scanning. It may be legal for the low airplane, but the pattern is full of pilots turning base and final who aren’t expecting someone flat and low from three miles out. Legal and safe are two different words.

How Do the Right-of-Way Rules Work in a Real Pattern?

Picture a busy Saturday morning, inbound to a non-towered field on a 45-degree entry to the downwind for Runway 36:

  1. A Cub is ahead of you on downwind, slower. You’re overtaking - the Cub has the right of way. Extend, slow down, and give up that spacing. Don’t turn base inside him.
  2. A Cherokee is converging from your right, entering downwind. Traffic on the right, converging - the Cherokee has the right of way. Adjust to slot in behind.

None of this works without talking and looking. The right-of-way rules are the tiebreaker, not the whole game. Position reports on the Common Traffic Advisory Frequency (CTAF) build everyone’s picture; 91.113 only decides who yields once paths conflict.

It’s worth tying in the regulations next door - FAR 91.126 and 91.127 - which govern the flow of traffic at non-towered airports. All pattern turns are to the left unless the airport specifies otherwise. That left-turn convention is what makes the right-of-way rules workable, because everyone flows the same direction and looks the same way. Conflicts are born the moment someone does their own thing.

What Should You Actually Carry Out to the Airplane?

First: the ladder is about maneuverability - distress at the top, then balloons, gliders, airships, then the rest of us, with towing and refueling aircraft bumped up high. Remember the why and you never memorize the what.

Second: for two airplanes meeting - converging, give way to the aircraft on your right and pass behind; head-on, both break right; overtaking, the slower airplane in front has the right of way and you pass to the right.

Third: on final and landing, the aircraft on final and the lower aircraft have the right of way - but you can never use those rules to cut in front of or overtake someone who was there first.

Fourth, and most important: having the right of way is a responsibility, not a privilege. Maintain course and speed so the other pilot can plan around you, keep your eyes outside, and deviate when it’s clear the other aircraft hasn’t seen you. FAR 91.3 makes you, the pilot in command, the final authority for the safety of the flight - right of way or not.

Next time you’re in a busy pattern, narrate it out loud: “Traffic on the right, converging, he’s got it, I’ll extend. Slower traffic ahead, I’m overtaking, I’ll give way right.” That’s how it moves from a page in the Airman Certification Standards into something your hands just do. Section 91.113 is shorter than you think - read it tonight, and it’ll finally mean something.
