But those numbers rest on top of a single survival principle stated first in the rule: you must always fly high enough that if your engine quits, you can make an emergency landing without endangering people or property on the ground. Understand that principle and the numbers stop feeling arbitrary - they scale to how many options you have and how many people are at risk.

What Does FAR 91.119 Actually Say?

The regulation opens with the sentence most pilots skip to get to the numbers, and that sentence is the entire point.

Paraphrased: except when necessary for takeoff or landing, no person may operate an aircraft below an altitude that would allow, if a power unit fails, an emergency landing without undue hazard to persons or property on the surface.

This is paragraph (a), and it applies everywhere - over the city, the farm, the lake, the desert. Always. It is the floor beneath the entire rule. The specific altitudes that follow are minimums the Federal Aviation Administration layered on top of that survival test. The engine-out test comes first, and it never turns off.

How High Must I Fly Over a City or Town?

Over a congested area - a city, town, or settlement - or over any open-air assembly of people, you must remain at least 1,000 feet above the highest obstacle within a horizontal radius of 2,000 feet of the aircraft.

Two details trip pilots up:

  • It’s above the highest obstacle, not the ground. If there’s a radio tower or tall building below, you measure from the top of it - not the dirt.
  • It’s the highest obstacle within 2,000 feet in every direction. Picture a circle 4,000 feet across, centered on your airplane. Find the tallest thing inside it, and stay 1,000 feet above that. You can be 1,000 feet over the field you’re crossing and still be illegal because a tower sits off to your side.

That backyard barbecue counts too. An open-air gathering of people is spelled out in the congested-area paragraph, so the moment you’re over the party you owe it 1,000 feet above the highest obstacle within 2,000 feet. Nobody sees a wing waggle from 1,000 feet up and half a mile out.

How Low Can I Fly Over Open Country?

Over areas other than congested - farmland, forest, empty desert - you must stay at least 500 feet above the surface.

But the next line is where low-flying pilots get caught. Over open water or sparsely populated areas, you may go below 500 feet. If you do, you may not operate closer than 500 feet to any person, vessel, vehicle, or structure.

So in truly empty country there is no hard floor - you could legally fly at 200 feet. But the instant a person, boat, car, or barn appears, you owe it a 500-foot bubble in every direction. Not 500 feet up - 500 feet away, measured any direction: above, beside, or diagonal. Five hundred feet of clearance from that object.

What About Takeoff and Landing?

The phrase “except when necessary for takeoff or landing” is a real exception. It’s what lets you descend through these altitudes on final and climb up through them on departure. You will obviously be below 500 feet over the neighborhood off the runway when you’re on short final - that’s legal, because it’s necessary for landing.

But “necessary” does a lot of work. It does not mean anytime you feel like being low. A low approach at a towered field as part of the flow is fine. A 300-foot pass down the runway to show off, then a climb back out with no intent to land, is much harder to defend - and inspectors have made that argument stick. If you’re going to fly the length of a runway low, do it as part of an actual approach or a coordinated maneuver, not a stunt.

Isn’t 500 Feet Also a Cloud-Clearance Rule?

This is where two numbers get tangled. You’ve heard 500 feet as the base of a lot of Class E airspace and as the “500 feet below the clouds” figure in the VFR cloud-clearance requirements. Those come from a different regulation entirely - FAR 91.155, which governs weather and airspace.

FAR 91.119 is about your height above the ground and above people. Two separate questions: one asks how far you are from the clouds, the other asks how far you are from the earth and everyone standing on it. Don’t let the shared “500 feet” fuse them in your head.

Why Does the Rule Use Two Different Numbers?

The regulation isn’t really about the FAA - it’s about physics and people. The FAA just wrote the physics down.

From 1,000 feet over a town you get roughly two minutes of glide and room to pick the least-bad option: a parking lot, a wide street, a ball field. From 500 feet over open country you get less time, but out there the least-bad option is an entire empty field. The altitudes scale to your outs and the stakes: more altitude over the city because your options are worse and more people are at risk; less over the country because it’s the opposite.

How Do I Apply This on a Real Flight?

Work through the gray areas the way the rule actually lives:

  1. Following a river for the scenery over farmland. Legal, as long as it’s genuinely sparsely populated and you keep 500 feet from any person, boat, car, or structure. But watch the bend that curves toward a town, the farmhouse in the trees, or the fisherman on the bank - the moment one enters your 500-foot bubble you’re in violation, and probably too low to react. Stay high enough that the bubble takes care of itself.

  2. Photo work over a rural property. With nobody around, you can legally get low. But the instant a car pulls up the driveway, that vehicle is owed 500 feet. The environment changed underneath you. This isn’t a number you set once at takeoff - it’s one you re-check as the world moves below you.

  3. Ground reference maneuvers. Turns around a point and S-turns across a road are built to be flown at a specific altitude - typically about 600 to 1,000 feet above the ground in the Airman Certification Standards. That floor keeps you inside 91.119 and high enough that a stall or botched steep turn at the bottom of the maneuver doesn’t become a smoking hole. When your instructor holds you to that altitude, they’re keeping you legal and alive at once.

The One Question to Ask Yourself

Don’t memorize this rule as “1,000 and 500.” Carry it as a continuous question: If the engine quit right now, where would I put it - and would I hurt anyone doing it? If you can answer that cleanly, you’re almost certainly legal, because the entire regulation was reverse-engineered from that exact question.

Realistically, the pilots who lose certificates over this rule rarely get caught in a random ramp check. It’s the phone call - someone on the ground gets buzzed, copies your N-number off the tail, and calls the Flight Standards District Office (FSDO). Fly normal cruise altitudes and stabilized approaches and you’ll go your whole career without thinking hard about 91.119. It only becomes a trap when you deliberately go looking for the ground.
