Federal Aviation Regulation 91.151 sets the legal minimum fuel for a flight in daytime visual conditions: enough to reach your first point of intended landing and then fly for at least 30 minutes at normal cruise. At night, that reserve climbs to 45 minutes. But the legal minimum is a floor, not a flight plan - and during a high-traffic event like EAA AirVenture Oshkosh, planning to that floor is how a routine cross-country becomes an emergency.

What Does FAR 91.151 Actually Require?

In plain English, 91.151 says you may not take off in an airplane under day VFR unless you carry enough fuel to fly to your destination plus 30 minutes at normal cruising speed. At night, the required reserve is 45 minutes.

Two details matter. First, the reserve is calculated at normal cruise - not at some optimistic, leaned-back, best-case burn rate. Second, this is a legal minimum. It’s the point below which you’ve broken a regulation, not the number you build your plan around.

Think of the reserve as the fuel you should never touch. If you’re burning into it, five decisions upstream already went wrong.

Because the reserve is what’s left over after everything goes according to plan - and during AirVenture, almost nothing does.

Here’s the realistic scenario. How Do I Build a Real Fuel Plan?

A real fuel plan works up from your actual numbers, not the regulation’s floor. Work through it in order:

  1. Start with your known burn. Use the gallons-per-hour you’ve actually seen at the pump, corrected for how you fly - not the figure from the POH when the airplane was new. If you don’t know your real burn yet, that’s your most valuable homework this week.

  2. Calculate fuel to destination at that burn, with a realistic cruise and a realistic climb. Climbing burns more - account for it.

  3. Add wind. A headwind makes you thirsty as well as late: same gallons per hour, less ground covered, longer trip, more total fuel. Check the winds aloft - Wisconsin afternoons build weather, and weather means delays.

What Should My Personal Fuel Minimum Be?

Higher than the regulation. For a trip into an event like AirVenture, stop thinking in minutes and start thinking in hours - aim to cross the fence with at least one hour of usable fuel in the tanks.

Pick that number and write it down. A solid personal minimum for a big fly-in is one hour of fuel on the ground, meaning you’ve decided in advance that if continuing to Oshkosh would put you on the ground with less than an hour, you divert for gas instead.

Make that decision at the kitchen table - not at 2,000 feet over Ripon with your heart pounding.

How Do FARs 91.103 and 91.3 Connect to Fuel?

These two rules travel with 91.151, and examiners want to see that you understand the family.

FAR 91.103 (Preflight Action) requires you to become familiar with all available information concerning a flight before you begin it. For a cross-country, that explicitly includes fuel requirements and alternatives available if the planned flight cannot be completed. The regulation itself names your fuel and your alternates as required knowledge - it’s practically writing the Oshkosh diversion plan for you.

FAR 91.3 (Responsibility and Authority of the Pilot in Command) makes you directly responsible for the operation of the aircraft and the final authority on that flight. Fuel is where that authority gets real. The controller is managing traffic, not your tanks; your friend at the North Forty isn’t in the cockpit. When fuel gets tight, it’s your airplane, your call, your certificate. 91.3 gives you the authority - and hands you the full weight of it.

How Does an Examiner Test Fuel Planning?

On the ground during the cross-country planning portion, the examiner wants to see a real fuel plan with reasoning - not just a total. Show that you account for taxi, run-up, climb, cruise, and reserve, and state your personal minimums out loud. If you just point at 30 minutes and say “that’s the reg,” you’ve technically answered and completely missed the point, and a good examiner will push you on it.

Then comes the scenario: the headwind is stronger than forecast, you’re behind your fuel plan, and your destination is backed up or socked in. The examiner is looking for a pilot who recognizes the trend early, already has a divert field in mind, and decides to get fuel before it becomes an emergency.

That’s not just a checkride skill. Fuel exhaustion (running the tanks dry) and fuel starvation (having fuel but not delivering it to the engine) are among the most preventable accident causes in general aviation. Every case is a chain of small decisions with an early link where someone could have simply landed and bought gas. Be the boring story - in aviation, boring means everybody went home.
