FAR 91.3 establishes one of the most fundamental principles in all of aviation: the pilot in command is directly responsible for, and the final authority over, every flight. Three paragraphs. The whole regulation reads in under a minute. Understanding what it actually requires of you takes considerably longer.

What Does “Pilot in Command” Actually Mean?

Paragraph (a) reads: “The pilot in command of an aircraft is directly responsible for, and is the final authority as to, the operation of that aircraft.”

Twenty-eight words. But buried inside them is an idea that shapes every flight decision you will ever make.

“Directly responsible” and “final authority” do not belong to the chief pilot, the company dispatcher, the FBO desk clerk, or the FAA examiner sitting across from you during your oral. When you are pilot in command, those words belong to you.

During dual training, the instructor holds the PIC designation most of the time - that changes the legal picture. It does not change the mindset a student should be building. The moment an instructor closes the door on solo day, paragraph (a) transfers entirely.

Who Has Authority Over Your Flight - ATC, Your Instructor, or You?

The answer is always you, once you hold PIC. This is where the regulation has real operational weight.

When Air Traffic Control issues a clearance, you are not obligated to accept it if it puts your aircraft somewhere you are not comfortable going. You can request a different routing, ask for more altitude, or ask for more time. Controllers have significant power to help you. They do not have authority to override your judgment about the safety of your own aircraft.

The NTSB accident record includes repeated examples of crews who had both the authority and the skill to question an instruction - and didn’t. Controlled flight into terrain. Spatial disorientation on approaches. VFR into instrument meteorological conditions (IMC). In case after case, someone deferred when they should have decided.

The same authority applies in situations that feel smaller: a passenger with schedule pressure, a flight school focused on monthly hours, an aircraft owner who wants to fly despite a questionable preflight finding. In every one of those moments, 91.3(a) says the same thing: you are the final authority, which means you also carry the authority to say no.

What Can You Do During an In-Flight Emergency?

Paragraph (b) reads: “In an in-flight emergency requiring immediate action, the pilot in command may deviate from any rule of this part to the extent necessary to meet that emergency.”

Any rule. In a genuine in-flight emergency, the FARs give you the legal authority to deviate from Part 91. You can land on a road. You can descend below an assigned altitude without a clearance. You can transit Class B airspace without radio contact. You can put down on a closed runway. If the situation requires it to protect the aircraft and the people on it, the deviation is lawful.

This is not an oversight in the regulation. The FAA acknowledged a fundamental truth: regulations exist to keep people safe, and there are moments when following a specific rule to the letter is itself the more dangerous choice.

What Does “To the Extent Necessary” Actually Mean?

Four words in paragraph (b) carry significant weight: “to the extent necessary.”

Not to whatever extent seemed reasonable under stress. The deviation must be proportional to the actual emergency.

Consider two scenarios. In the first, an engine runs rough on short final at a non-towered airport. The runway is temporarily closed for crack-sealing, but workers are clear of the surface. Landing there is necessary, proportional, and defensible - the alternative was a field landing with unknown surface conditions and no emergency equipment nearby.

In the second scenario, a pilot burning more fuel than planned due to unaccounted headwinds decides to land at a restricted military installation because it’s the closest paved surface - despite having three viable airports within comfortable range. If fuel state was not genuinely critical, “necessary” becomes much harder to argue. The FAA evaluates the full picture: what were the actual options, and what would a reasonable, prudent pilot have done with the same information?

“Necessary” in paragraph (b) is a standard, not a rubber stamp.

Do You Have to File a Report After an Emergency Deviation?

Paragraph (c) reads: “Each pilot in command who deviates from a rule under paragraph (b) shall, upon the request of the Administrator, send a written report of that deviation to the Administrator.”

Two points pilots frequently miss.

First: “upon request.” The regulation does not require automatic reporting after every emergency deviation. A written report is submitted if the FAA requests one. Whether they ask depends on the circumstances - an unremarkable deviation may never generate a request; an incursion into a restricted area or a pilot deviation notice from ATC almost certainly will.

Second: a written report is not automatically a violation notice. It is your account of what happened. If you acted appropriately, a clear and honest explanation of your reasoning actually protects you. It demonstrates that you understood the nature of the emergency, responded proportionally, and exercised the authority paragraph (b) specifically grants. In that context, the paperwork works in your favor.

How Is the NASA ASRS Report Different From the FAR 91.3(c) Report?

These are separate mechanisms, and confusing them is a common mistake.

The NASA Aviation Safety Reporting System (ASRS) is a voluntary, confidential reporting system administered by NASA on behalf of the FAA. Filing an ASRS report within 10 days of an incident generates a dated receipt that provides immunity from FAA certificate action for certain inadvertent regulatory violations - provided the violation was not criminal, was not deliberate, and is not related to an accident under investigation.

An ASRS report does not satisfy the FAR 91.3(c) reporting requirement. Filing the FAA report does not provide ASRS immunity. They are built for different purposes and neither replaces the other.

Know both systems. Know the 10-day window for ASRS specifically. Used correctly and honestly, both can be the difference between a closed file and a certificate action.

How Does FAR 91.3 Show Up on the Checkride?

The Airman Certification Standards (ACS) lists 91.3 as a knowledge area, but the regulation’s spirit runs underneath the entire practical test. The Designated Pilot Examiner (DPE) is not just checking whether you can recite the rule - they’re watching from the preflight walk-around to see whether you think and act like a pilot in command.

Do you make decisions or wait for them? When presented with a simulated diversion, do you work the problem or glance over for a cue? When asked a question you’re uncertain about, do you reason through what you know or wait for a hint?

The examiner wants to see someone who owns the flight. That is the live expression of 91.3 during a checkride - not in the oral question, but in every moment of the practical test.

How Do You Build PIC Authority Before Your Solo?

PIC posture is built during training, not awarded on checkride day. On every dual flight:

  • Form your own decision before your instructor speaks. Get in the habit of working the problem independently, even if you haven’t voiced it yet.
  • Make your radio calls with confidence, even while you’re still learning proper phrasing.
  • Conduct your preflight as if it is your aircraft and your call about whether it flies today.
  • Treat every go-no-go decision as yours to make, using your own assessment of conditions, currency, and personal minimums.

The goal is not to overstep your role as a student. It is to build the judgment that 91.3 will eventually require of you. On checkride day, the examiner is trying to confirm you’ve already developed it.
